1. Acceptance of Terms

By creating an account or using KitMate ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and KitMate.

2. Description of Service

KitMate is a vehicle lifecycle management application that allows you to track vehicles, manage registrations and inspections, store ownership documents, upload periodic photos, receive automated reminders, and generate sale export documents.

3. Account Registration

To use KitMate, you must create an account through our authentication provider. You agree to provide accurate and complete information, keep your login credentials secure, notify us immediately of any unauthorised use of your account, and accept responsibility for all activity under your account.

You must be at least 18 years of age to create an account and use the Service.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Upload malicious files, viruses, or harmful code
• Attempt to gain unauthorised access to other accounts or our systems
• Use automated scripts to access or scrape the Service
• Interfere with the proper functioning of the Service
• Upload content that infringes on intellectual property rights of others
• Misrepresent your identity or vehicle information for fraudulent purposes

5. Your Content

You retain ownership of all data, documents, and photos you upload to KitMate ("Your Content"). By uploading content, you grant us a limited licence to store, process, and display Your Content solely for the purpose of providing the Service.

You are responsible for ensuring that Your Content is accurate and does not violate any laws or third-party rights. We do not verify the accuracy of vehicle information you provide.

6. Vehicle Information Disclaimer

KitMate is a record-keeping tool. We do not verify, certify, or guarantee the accuracy of any vehicle information stored in the Service. Vehicle data, inspection records, and sale documents generated by KitMate are based solely on information you provide.

KitMate does not replace official government vehicle registries, roadworthiness inspections, or legal transfer-of-ownership processes. Always consult your local transport authority for official records.

7. Reminders and Notifications

KitMate may send you email reminders about registration renewals, inspections, and periodic photo updates. These reminders are provided as a convenience and are not guaranteed to be timely or error-free. You remain solely responsible for meeting all legal deadlines related to your vehicles.

8. Sale Export Documents

When you record a vehicle sale, KitMate generates a PDF export document summarising the vehicle's history. This document is for informational purposes only and does not constitute a legal certificate of title, roadworthiness, or transfer of ownership. Buyers and sellers should complete all legally required documentation independently.

9. Service Availability

We aim to keep KitMate available at all times but do not guarantee uninterrupted service. We may temporarily suspend the Service for maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned downtime.

10. Limitation of Liability

To the maximum extent permitted by law, KitMate and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, missed deadlines, inaccurate vehicle records, or inability to access the Service.

Our total liability for any claim arising from the Service shall not exceed the amount you paid us (if any) in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless KitMate, its operators, and affiliates from any claims, losses, or damages arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Account Termination

You may delete your account at any time through the application settings. We may suspend or terminate your account if you violate these Terms, use the Service for fraudulent purposes, or remain inactive for an extended period (with prior notice).

Upon termination, your data will be deleted in accordance with our Privacy Policy.

13. Modifications to Terms

We may modify these Terms at any time. Material changes will be communicated via email or an in-app notification. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the Commonwealth of Australia. Any disputes arising from or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
